Copyright Infringement Policy

1. Introduction

This Copyright Infringement Policy ("Policy") sets forth the guidelines and procedures to address copyright infringement issues on the freelance marketplace known as Gigsgen ("Website") operated by Gigsgen Digital Innovations Limited ("Gigsgen"). By using the Website, all users ("Users") agree to comply with this Policy and any related policies or guidelines implemented by the Gigsgen. Failure to comply with this Policy may result in disciplinary action, including account suspension or termination, and may have legal consequences under applicable UK and other universal laws.

 

2. Copyright Infringement Notification

2.1 Reporting Copyright Infringement

If you believe that your copyright-protected work has been used or displayed on the Website in a manner that constitutes copyright infringement, please promptly notify the Gigsgen's designated Copyright Agent ("Agent") in writing. The notice should include the following information:

a) Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are involved, a representative list of such works.

b) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including information reasonably sufficient to locate the material (e.g., URL).

c) Sufficient contact information, including your name, address, telephone number, and email address.

d) A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.

e) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

f) Your physical or electronic signature.

3. Gigsgen's Response to Copyright Infringement Notifications

3.1 Notice Review and Removal

Upon receiving a valid copyright infringement notification, the Gigsgen will promptly review the information provided and take appropriate action, which may include removing or disabling access to the allegedly infringing material. The Gigsgen may also notify the alleged infringer and provide them an opportunity to respond.

3.2 Counter-Notification Process

If a User believes that their content was removed or disabled as a result of a mistake or misidentification, they may submit a counter-notification to the Agent. The counter-notification must include the following information:

a) Identification of the material that has been removed or disabled and the location where the material appeared before removal or disabling.

b) A statement, under penalty of perjury, that the User has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.

c) Sufficient contact information, including the User's name, address, telephone number, and email address.

d) A statement that the User consents to the jurisdiction of the courts in which the Gigsgen's registered office is located and that they will accept service of process from the person who provided the copyright infringement notification or their agent.

e) The User's physical or electronic signature.

3.3 Agent's Response to Counter-Notification

Upon receiving a valid counter-notification, the Agent will promptly review the information provided and, if appropriate, restore the removed or disabled material. The Gigsgen will also notify the original complainant of the counter-notification and provide them an opportunity to pursue legal action if desired.

 

4. Repeat Infringers

The Gigsgen has a zero-tolerance policy for repeat copyright infringers. Users who repeatedly infringe upon the copyrights of others may have their accounts suspended or terminated in accordance with the Gigsgen's Terms of Service.

 

5. Disclaimer

The Gigsgen does not endorse or verify the accuracy, validity, or legality of the content posted on the Website by its Users. Users are solely responsible for ensuring that their content does not infringe upon the copyrights or intellectual property rights of others. The Gigsgen disclaims any liability for copyright infringement by its Users and reserves the right to remove or disable access to infringing material upon receipt of a valid copyright infringement notification.

 

6. Amendments to the Policy

The Gigsgen reserves the right to modify or update this Policy at any time without prior notice. Users are responsible for reviewing the Policy periodically to ensure compliance with the most current version.
